By accessing, browsing, or using The Doodle Cast website (the "Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, users, and others who access or use the Site. If you are using the Site on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

The Doodle Cast is an AI-animated dog podcast featuring Rusty and Oreo. The Site provides access to the following features and content:

• Episodes: AI-animated podcast episodes available for streaming
• The Gazette: Blog posts covering dog-related news, tips, and stories
• Doodle Stack: An interactive browser game with a public leaderboard
• Chatbot: AI-powered chat with Rusty & Oreo characters
• Newsletter: Email updates about new episodes, posts, and announcements
• Dog Casting Submissions: A form at /apply/ where dog owners can submit their dogs to potentially appear on the show
• Comments: Community comments on Gazette blog posts

We reserve the right to modify, suspend, or discontinue any part of the Site at any time without prior notice.

3. User-Generated Content

The Site allows you to submit certain content, including but not limited to:

• Comments on Gazette blog posts
• Game scores on the Doodle Stack leaderboard
• Chat messages with the Rusty & Oreo chatbot
• Dog casting submissions via the /apply/ form

By submitting content to the Site, you grant The Doodle Cast a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify, and distribute your submitted content in connection with the Site and its promotion.

You represent that you own or have the necessary rights to the content you submit, and that your content does not violate the rights of any third party.

We reserve the right to review, moderate, edit, or remove any user-generated content at our sole discretion, for any reason, without notice.

4. Dog Casting Submissions

By submitting your dog's information through the /apply/ form, you agree to the following:

• You grant The Doodle Cast permission to use your dog's name, likeness, photos, and any other submitted information to create AI-animated content, including but not limited to podcast episodes, promotional materials, and social media posts
• You represent and warrant that you are the owner of the dog (or have been authorized by the owner) and that you have the rights to all photos and information submitted
• Selected dogs may appear in episodes featuring AI-generated voices, animations, and characterizations. The AI-generated portrayal is a creative interpretation and may not reflect your dog's actual personality or behavior
• Submission does not guarantee selection or appearance on the show
• You may request removal of your submission at any time by contacting [email protected]

5. Chatbot (Rusty & Oreo)

The Doodle Cast features an AI-powered chatbot where you can interact with the characters Rusty and Oreo. Please be aware of the following:

• AI-generated responses: All chatbot responses are generated by artificial intelligence. They are for entertainment purposes only and should not be taken as professional advice of any kind (veterinary, legal, medical, financial, or otherwise)
• Conversation storage: Conversations may be stored for the purpose of improving the chatbot experience and for moderation. See our Privacy Policy for details
• Local AI processing: Your chat messages are processed by a locally hosted AI model on private hardware. They are not sent to external AI providers such as OpenAI or Anthropic
• No guarantees: We do not guarantee the accuracy, completeness, or appropriateness of any chatbot response

6. Newsletter

If you subscribe to The Doodle Cast newsletter, you agree to receive periodic emails about new episodes, Gazette posts, and other announcements. You may unsubscribe at any time using the unsubscribe link included in every email. Our newsletter is delivered via Resend. For details on how we handle your email address, see our Privacy Policy.

7. Intellectual Property

All original content on the Site is owned by The Doodle Cast, including but not limited to:

• Podcast episodes (scripts, storylines, dialogue)
• Characters (Rusty, Oreo, and all other featured characters)
• Artwork, illustrations, and visual designs
• Music, sound effects, and audio compositions
• Website design and code
• The Doodle Cast name, logo, and branding

AI-generated content on the Site (including images, voices, animations, and video) is created using various AI tools and remains the property of The Doodle Cast.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Site without prior written permission from The Doodle Cast.

8. Prohibited Conduct

When using the Site, you agree not to:

• Post spam, unsolicited promotions, or repetitive content
• Harass, threaten, or abuse other users or site operators
• Impersonate any person, character, or entity, or misrepresent your affiliation
• Scrape, crawl, or use automated tools to extract data from the Site without permission
• Upload or transmit malicious code, viruses, or any harmful content
• Attempt to gain unauthorized access to the Site, its servers, or any associated systems
• Use the Site for any illegal or unauthorized purpose
• Interfere with or disrupt the Site's operation or other users' enjoyment of the Site
• Submit false or misleading information in dog casting applications

Violation of these rules may result in removal of your content, a ban from the Site, or other appropriate action at our discretion.

9. Third-Party Links & Embeds

The Site may contain links to or embeds from third-party services, including:

• YouTube: Embedded video players for podcast episodes and clips
• Spotify: Embedded players for podcast audio
• Social media: Links to The Doodle Cast accounts on YouTube, Instagram, TikTok, and other platforms

These third-party services have their own terms of service and privacy policies. The Doodle Cast is not responsible for the content, practices, or availability of any third-party sites or services. Inclusion of any third-party link or embed does not imply endorsement.

10. Disclaimer

The Site and all its content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Specifically, please note:

• AI-generated content (including episodes, images, animations, and chatbot responses) may contain inaccuracies, errors, or unintended content
• The Doodle Cast does not guarantee that the Site will be available at all times, be error-free, or be free of viruses or other harmful components
• Chatbot responses are AI-generated and are not professional advice. Do not rely on them for veterinary, medical, legal, or financial decisions
• Game scores and leaderboard data are provided for entertainment purposes

11. Limitation of Liability

To the fullest extent permitted by applicable law, The Doodle Cast, its operators, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with:

• Your access to or use of (or inability to access or use) the Site
• Any content posted on or obtained through the Site
• Any AI-generated content, including chatbot responses
• Unauthorized access to or alteration of your transmissions or data
• Any third-party content, links, or embeds on the Site

This limitation applies whether the alleged liability is based on warranty, contract, tort, negligence, strict liability, or any other legal basis, even if The Doodle Cast has been advised of the possibility of such damages.

12. Indemnification

You agree to defend, indemnify, and hold harmless The Doodle Cast, its operators, and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

• Your use of the Site
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any content you submit to the Site

13. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we may also notify newsletter subscribers via email.
